Військова служба в Україні: поняття та кримінологічно значущі змістовні ознаки

Abstract

Якщо у цілому узагальнити нормативно-правові та наукові підходи, що сформувались з означеного питання в Україні, то можна запропонувати наступне визначення поняття «військова служба», а саме – це особливий вид державної служби в Україні, який ґрунтується на положеннях Конституції України та інших законодавчих актів, що визначають діяльність громадян України, іноземців та осіб без громадянства, яка пов’язана із обороною, захистом суверенітету і територіальної цілісності країни, а також з реалізацією визначених, у зв’язку з цим, у законі функцій держави.

If we generalize the normative-legal and scientific approaches that have been formed on this issue in Ukraine, then we can offer the following definition of the concept of "military service", namely, it is a special type of public service in Ukraine, which is based on the provisions of the Constitution of Ukraine and other legislative acts determining the activities of Ukrainian citizens, foreigners and stateless persons, which is related to the defense, protection of the sovereignty and territorial integrity of the country, as well as the implementation of the functions of the state defined in this regard in the law.
